Maryland Surplus Funds Laws

How mortgage foreclosure surplus, tax sale surplus and unclaimed funds work in Maryland.

General information only, not legal advice. Laws and county procedures change, and local rules may differ. Confirm the current rules with the court, county or a licensed attorney before acting. Last updated: November 2026.

Mortgage foreclosure surplus

Md. Rule 14-216 directly governs claims to mortgage foreclosure-sale surplus; Md. Code, Real Property § 7-105 and the rest of Rule 14 govern the foreclosure sale and audit. Under Rule 14-216, a person claiming proceeds may apply after the sale and before final ratification of the auditor’s account. This audit deadline is the key filing marker; the separate property-redemption rule does not replace it.

Tax sale surplus

Md. Code, Tax–Property § 14-818(a)(4)–(6) directs the collector to pay any excess tax-sale bid balance to the entitled person, establishes a uniform county claim process without a court order unless payment is disputed, and requires owner notice within 90 days after deed. Section 14-819 addresses unlocated claimants. There is no single short filing period in § 14-818. For an unknown or unlocated person, § 14-819 requires county retention for at least three years; after court-ordered forfeiture, an entitled person may seek repayment by court order within seven more years. Track the deed, notice and any forfeiture order.

Unclaimed funds

Maryland Abandoned Property Act, Md. Code, Commercial Law tit. 17, subtit. 3; § 17-318 governs claims to the State Comptroller. Section 17-318 has no fixed initial owner-claim cutoff. A claim not acted on for six months is deemed denied, with further action under § 17-320; this is separate from tax-sale proceeds retained by a county.
