Wyoming Surplus Funds Laws
How mortgage foreclosure surplus, tax sale surplus and unclaimed funds work in Wyoming.
Mortgage foreclosure surplus
Wyo. Stat. § 34-4-113(a)–(c) directly governs mortgage foreclosure sale proceeds: expenses, foreclosed mortgage, junior liens, then surplus to the mortgagor on demand or through unclaimed-property procedures. Section 34-4-113 states no fixed initial mortgagor demand deadline. The 30-day period in subsection (b) concerns a junior lienholder’s demand after service of sale results, not the owner’s deadline.
Tax sale surplus
Wyo. Stat. § 39-13-108(d)(iii)–(iv) governs judicial foreclosure of a property-tax lien and payment of sale proceeds; § 39-13-108(e) separately governs tax-lien certificates and administrative tax deeds, which may create no cash surplus. After judicial tax-lien foreclosure, persons holding prior interests may claim the balance within two years after court confirmation; legal disability gets one year after removal (§ 39-13-108(d)(iv)(C)). Redemption before confirmation is separate.
Unclaimed funds
Wyoming Uniform Unclaimed Property Act, Wyo. Stat. §§ 34-24-101 et seq.; § 34-24-125 governs owner claims to the State Treasurer. Section 34-24-125 sets no fixed general initial owner-claim cutoff. If denied, judicial review under § 34-24-127 must be brought within 90 days of decision, or 180 days after filing if the administrator fails to act.
