General information only, not legal advice. Laws and county procedures change, and local rules may differ. Confirm the current rules with the court, county or a licensed attorney before acting. Last updated: November 2026.

Mortgage foreclosure surplus

RCW 61.24.080(1), (3) governs deed-of-trust sale proceeds. The trustee deposits surplus with the superior court clerk; eliminated liens attach by priority and the court orders payment on motion. RCW 61.24.080(3) states no fixed initial deadline to move for surplus, but requires service of the motion at least 20 days before the hearing. File in the superior court where the sale occurred; the redemption timeline is separate.

Tax sale surplus

RCW 84.64.080(10) governs excess from real-property tax foreclosure sales, after recorded water-sewer district liens, with a claim to the county treasurer by the specified record owner. The record owner must claim tax-sale excess from the county treasurer within three years after sale. At expiration, it goes to the county current expense fund and all owner claims are extinguished (§ 84.64.080(10)).

Unclaimed funds

Washington Revised Uniform Unclaimed Property Act, RCW ch. 63.30; §§ 63.30.530–.560 govern owner claims, decisions and review. RCW 63.30.530 sets no fixed general initial owner-claim cutoff. A court action on a denied or deemed-denied claim must be started within one year after filing the claim (§ 63.30.560).
