Oklahoma Surplus Funds Laws
How mortgage foreclosure surplus, tax sale surplus and unclaimed funds work in Oklahoma.
Mortgage foreclosure surplus
For judicial mortgage foreclosure, Okla. Stat. tit. 12, § 773 requires the officer to pay overplus to the defendant on demand after the writ, interest and costs are satisfied. For a contractual power-of-sale foreclosure, tit. 46, § 48 sets payment priorities and permits court deposit for disputed proceeds. Neither tit. 12, § 773 nor tit. 46, § 48 states a fixed general owner surplus-claim cutoff. Demand from the sheriff/mortgagee or apply to the district court if proceeds were deposited. The appraisal and six-month sale-delay rules concern sale procedure, not surplus.
Tax sale surplus
Okla. Stat. tit. 68, § 3131(C) governs excess bids at a county tax resale. It requires a separate fund for the record owner as of the start of resale and invalidates assignments made on or after that date. The owner must withdraw tax-resale excess proceeds within one year of the resale (§ 3131(C)); remaining money then enters the county resale property fund. The assignment rule is separate from this claim period.
Unclaimed funds
Oklahoma Uniform Unclaimed Property Act, Okla. Stat. tit. 60, §§ 651 et seq.; § 674 governs claims to the State Treasurer. Section 674 sets no fixed general initial owner-claim cutoff for property held by the Treasurer. Its 90-day review period begins after a complete claim is filed.
