Missouri Surplus Funds Laws
How mortgage foreclosure surplus, tax sale surplus and unclaimed funds work in Missouri.
Mortgage foreclosure surplus
Mo. Rev. Stat. § 443.410 authorizes trustee foreclosure and addresses a limited property-redemption right; it is not a surplus-distribution statute. Deed-of-trust terms and Missouri priority case law govern payment of junior interests and any remaining amount to the person entitled. No uniform mortgage trustee-sale surplus filing deadline is stated in § 443.410. Its one-year redemption applies only in specified purchases by or for the debt holder after required notice and is not a surplus-claim clock.
Tax sale surplus
Mo. Rev. Stat. § 140.230 is the direct county tax-sale surplus statute. It requires county treasury custody, priority payment to former recorded lienholders and then former owners, satisfactory proof, and interpleader for unresolved competing claims. A written claim under § 140.230(3) must be filed with the county commission within 90 days after the redemption period expires. No surplus is paid outside redemption until 90 days after that period; after three years undistributed money becomes the permanent county school fund. These are distinct clocks.
Unclaimed funds
Missouri Uniform Disposition of Unclaimed Property Act, Mo. Rev. Stat. §§ 447.500–447.595; § 447.562 governs claims to the State Treasurer. Section 447.562 states no fixed general initial owner-claim cutoff for property held by the Treasurer. County tax-sale surplus under § 140.230 has its own filing and disposition rules.
