Effective: November 3, 2026 | Last updated: November 3, 2026 | Print
- Use the Services only for lawful surplus funds recovery work.
- You are responsible for following the TCPA, Do Not Call rules, CAN-SPAM, and state telemarketing and surplus funds laws.
- If you use our cold calling services, our callers act for you under your authorization, and you remain the caller of record.
- Data we provide is licensed for your own business: no resale, scraping, bulk export, AI training or consumer report use.
- Do-not-call flags are informational and do not replace your own checks.
- Breaking these rules can lead to suspension. Fees follow our Refund Policy.
A plain-language summary. The full text below controls.
1. Relationship to the Terms
This Acceptable Use Policy (“Policy”) sets the rules for using the services offered by Surplus Fortune (“we”, “us”, “our”), including lead lists, skip tracing, cold calling assistants, CRM management, website services and the member area (together, the “Services”). It works alongside our Terms and Conditions, Privacy Policy and Refund Policy. By using the Services you agree to follow this Policy.
You are responsible for everyone who uses the Services under your account, including team members you add and anyone who acts for you.
2. Your Responsibility for Legal Compliance
We provide data, staffing and tools that you direct. You decide who is contacted, how and when, and you are responsible for making sure your activity is lawful. That includes compliance with:
- the Telephone Consumer Protection Act (TCPA) and the FCC rules under it, including 47 C.F.R. § 64.1200;
- the Telemarketing Sales Rule and the National Do Not Call Registry;
- the Truth in Caller ID Act;
- the CAN-SPAM Act;
- state telemarketing and telephone solicitation laws, including any registration, licensing or bonding they require;
- state laws on recovering surplus funds, excess proceeds and unclaimed property (Section 5);
- federal and state call-recording laws, including those that need every party’s consent;
- the Fair Credit Reporting Act, the Gramm-Leach-Bliley Act and the Driver’s Privacy Protection Act (Section 7); and
- privacy, consumer protection and anti-deception laws.
In practice, scrub your lists, keep your own internal do-not-call list, honor opt-outs promptly, respect calling-time limits in the called person’s time zone, identify your business accurately and keep records that show your compliance. We do not audit or verify your compliance, and nothing we say or provide is legal advice. Talk to a licensed attorney about your specific situation.
3. Sender Status, Consent and Records
You are the business making each call, sending each email and mailing each letter that you create, approve or direct, including outreach our assistants carry out for you under Section 6. You are responsible for its content, its recipients and its timing.
We do not obtain or verify consent for you. Before anyone contacts a person for you, you must have any consent the law requires for that channel and purpose. Keep records of how and when consent was given and when opt-outs were received, for at least five years or longer if the law requires, and be ready to produce them to us if we ask. Consent given to someone else, and lists bought from others, are not your consent.
4. Channel Rules
4.1 Calls
- Call only within lawful calling times in the called person’s time zone. Federal rules generally allow calls from 8 a.m. to 9 p.m., and some states set narrower windows. Check the rules for each state you call.
- Identify your business and give a callback number when asked.
- Use only caller ID numbers you are authorized to use. Do not spoof or hide who is calling.
- You are responsible for any notice or consent needed to record calls, including in states that need every party’s consent.
- Do not use prerecorded or artificial voice calls through the Services.
4.2 Text messages
We do not provide texting tools or send text messages for you. If you text people yourself, you are responsible for consent, opt-out handling, carrier rules, A2P 10DLC registration and applicable law.
4.3 Email
If you send email, follow the CAN-SPAM Act and state law: accurate sender and subject lines, your physical mailing address, a working unsubscribe method, and prompt handling of unsubscribe requests.
4.4 Direct mail
Do not send mail that is false or misleading, that looks like it comes from a court, county or government agency, or that misstates deadlines, urgency or legal consequences. Letters and templates are examples, not legal advice, and you should have them reviewed by an attorney.
5. Surplus Funds Recovery Laws
Many states regulate surplus funds and unclaimed property recovery. Depending on the state, rules may limit or ban fees, require a license or registration, set waiting periods before owners may be contacted or agreements signed, require written disclosures (such as telling owners they can claim the money themselves without paying anyone), restrict assignments, or void agreements obtained through certain kinds of solicitation.
Scripts, protocols, agreements and letters we provide are samples. You must adapt them to the rules of each state and county where you work before you use them. You must not use the Services, or ask our assistants, to contact owners in a way those rules forbid.
6. Assistant Outreach Authorization
If you buy cold calling or similar assistant services, the following applies.
6.1 What you authorize
You authorize us and our assistants, acting for you for this limited purpose, to work the lead lists and contact details you provide or license from us, within the states, counties, call windows and instructions you set, and to use scripts and talking points you approve.
6.2 You remain the caller of record
Every call made under this authorization is made for you and in your name. You are responsible for it as if you had made it yourself, including its compliance with Sections 2 to 5.
6.3 Your confirmations
For every number we call for you, you confirm that the do-not-call checks the law requires have been done, that you have any consent the law requires, and that the outreach is lawful in the places it is made. Do-not-call flags in our data are informational and are not your registry check.
6.4 Opt-outs and restrictions
Tell us in writing about any restriction on a lead or number and any opt-out you receive through another channel. Our assistants will record and honor opt-out requests made during calls. We may refuse or stop any instruction we believe is unlawful.
6.5 Duration
This authorization lasts while you have assistant services. Ending it does not affect outreach already made.
7. Licensed Data and Automated Access
7.1 Licensed data
Lead lists, skip tracing results and other data we provide (“Licensed Data”) are for your own internal surplus funds recovery business, within your plan and the team members it allows. You must not:
- copy, export or collect Licensed Data in bulk beyond what your own case work reasonably needs;
- build a copy or competing database of any part of it;
- sell, license, share, publish or transfer it to anyone outside your organization;
- keep using it after your subscription ends or while it is suspended;
- use it to train, fine-tune or evaluate an artificial intelligence or machine learning model; or
- use it as a consumer report, or to decide anyone’s eligibility for credit, insurance, employment, housing or tenancy. Our data is not a consumer report and we are not a consumer reporting agency.
7.2 Automated access
Use the Services only through the pages and tools we provide. Do not access, search, copy or collect any part of the Services by automated means such as bots, crawlers, scrapers or scripts, and do not get around any access or volume limit, without our written permission.
7.3 Skip trace and contact data
Some contact data may come from sources covered by the Gramm-Leach-Bliley Act or the Driver’s Privacy Protection Act. By ordering or using it, you confirm that you will use it only to locate and contact people about surplus funds for your own recovery business, that your use is permitted under those laws, that you will not use it to obtain information under false pretenses, to harass or stalk anyone, or for any unlawful purpose, and that you will keep it secure and limit access to team members who need it. If you cannot confirm this, do not order or use the data. See also our DNC and Data Disclosure.
8. Attestations
We may ask you to confirm certain statements, for example when you start a service, order skip tracing or begin outreach. Each confirmation must be true when you make it, and we may rely on it. A false confirmation is a material breach of this Policy.
9. Other Prohibited Uses
You must not use the Services to:
- break any law, or help anyone else do so;
- send spam, or contact anyone who has asked not to be contacted;
- harass, threaten or mislead anyone, including by misrepresenting who you are, whom you represent, the amount of funds, or the owner’s rights;
- pose as a person, business, court, county or government agency;
- access accounts, data or systems without authorization, or interfere with the Services or our security;
- copy or reverse engineer the Services, or use them to build a competing product or database;
- resell the Services, or share your login with anyone outside your plan’s team members; or
- upload malware or content you have no right to use.
10. Enforcement
We may investigate suspected violations and review activity on your account. If we believe you have broken this Policy, or a regulator, carrier or contacted person complains, we may remove content, pause outreach, suspend or limit your access, keep records of the activity, report it to authorities where appropriate, and end your service under the Terms. Fees are handled under our Refund Policy. Not acting on a violation does not waive our right to act later. To report a violation or complaint, email support@surplusfortune.com.
11. Changes
We may update this Policy from time to time. The “Last updated” date at the top shows the latest version. Changes required by law may take effect right away. Continued use of the Services after a change means you accept the updated Policy.
